Ceramitaly conditions of sale.

These general sales conditions govern the purchase of products and services, carried out remotely via telematic network on the site www.ceramitaly.it with headquarters in Martanello (MO) Via per vignola 37. Purchases are reserved for direct customers and resellers. Every purchase transaction shall be regulated by the provisions of Legislative Decree no. 185/99 (implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts) and, as regards the protection of confidentiality of personal data, shall be subject to the regulations set out in Legislative Decree no. 196 of 30 June 2003 (Consolidation Act on the confidentiality of data). Ceramitaly may be obliged to modify some of these provisions; therefore, Customers are advised to read the Conditions of Sale each time they visit the Ceramitaly website. Validation of the order shall be deemed as acceptance of the Conditions of Sale, without any possible recourse. By purchasing from the "Ceramitaly" website, Customers undertake to respect the Conditions of Sale.

Product information

Photographs presenting the products are not part of the contractual scope and can in no case be considered as the responsibility of Ceramitaly. Technical data sheets and product descriptions are provided by Ceramitaly's partners and/or suppliers and Ceramitaly declines all responsibility for their content.

Prices and purchase methods

Ceramitaly is a website for the sale of ceramic floor and wall tiles. Purchases of the products described online in the relevant data sheets can be made by the Customer at the price indicated on the site. Sales prices are expressed in euros (€) and include VAT. When filling out the order, the transport costs will also be specified. Before the Customer confirms the purchase, a summary will be displayed containing the unit cost of each product chosen, the total cost in the event of purchasing more than one product and the relative transport costs.


Customer orders are satisfied within the limits of the quantity of products available. In the event that the chosen product is not available, the Customer can make a request for an estimate and Ceramitaly undertakes to reply by e-mail within 3 working days from the date of the request with information regarding the time required for delivery of the product. In the event that only some of the chosen products are not available, Ceramitaly commits to immediately ship the available products, as soon as the missing products are available Ceramitaly will contact the customer in order to ship the remaining products. In the event that the unavailability of the product is due to a definitive stop in production of the same by the manufacturer, Ceramitaly will propose a product of equivalent quality and price to the customer. In case of refusal by the customer, Ceramitaly will proceed to refund the unavailable product.

Delivery and shipping methods

The order will be delivered to the address indicated at the time of the order. Packaging costs are also included in the shipping rates. Ceramitaly offers different delivery methods: For shipping we use express courier, prices depend on weight and volume The goods can be picked up at the shop. The delivery times indicated on the Ceramitaly website are indicative and are subject to change. We also remind Customers that couriers transport and deliver products only on weekdays. Ceramitaly cannot be held responsible for the consequences of any delays in delivery or the loss or damage of the order by the courier. In the event that the order has not been delivered on time Ceramitaly may, upon request of the Customer, investigate the reasons for such delay. During this period (about 15 days) it will not be possible to proceed with a refund or a new shipment of the order. The delivery will be carried out by the national courier. In order to have information on the delivery status, please communicate to the courier the number of the delivery note received by e-mail. Important indications for the receipt of products When the courier delivers the goods, it is advisable to check that: The number of packages delivered corresponds to that indicated in the transport document -The packaging is intact, undamaged, or wet or otherwise altered, including the sealing materials (adhesive tape or metal strapping) Any damage or mismatch in the number of packages or information, must be immediately reported to the courier who delivers the goods by accepting them with a reserve to be written only in the courier's delivery note, eg. E.g. "I accept with reserve control box with holes on the right side", "open box" ... I accept with reserve control package disconnected, I accept with reserve control package dented, tape courier ect ...ect .... if the product is visibly damaged or the courier refuses the reserve in the bill, refuse the product and indicate on the bill "package refused because 'visibly damaged" or "package refused because the courier refuses the reserve" and immediately notify us.

Attention: We remind you that in order to obtain compensation for any damage, it is important that the shipment is accepted by affixing the following wording to the courier's delivery note: e.g. "I accept the goods subject to verification because the package is damaged, etc.". It is imperative to affix the wording "subject to verification" even if the package appears externally intact (e.g.: I accept the goods subject to verification, package intact). Once the courier's document has been signed, the Customer may not raise any objection regarding the external characteristics and physical integrity of the goods delivered, therefore if the products are accepted without reservation, no claims will be accepted and it will not be possible to start the procedure for replacing the goods. Any problems concerning the products received must be reported no later than 8 days after delivery (the date indicated on the courier's delivery note will be taken as proof).



Customers have the opportunity, at the time of delivery of the order to check that the package does not have any external apparent damage or anomaly. For each delivery, customers must sign with reserve. In the event that the product or package shows obvious damage, we recommend that you fill out the form provided and not accept the delivery, returning it to the courier who will return the product. Customers should also send an e-mail to info@ceramitaly.it. Additional information may be requested from Customers in order to definitively validate the purchase. In order to allow Ceramitaly to contact them in case of need, Customers are requested to indicate - A working e-mail address - A telephone number

Right of withdrawal - satisfied or refunded

Sales of products via the Internet are governed by the law D.Lgs n. 185 of 22/05/1999 which regulates the matter of distance contracts, i.e. made outside of business premises. This legislation sanctions the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain a refund of the expense incurred. This right is reserved exclusively for natural persons (consumers), so it cannot be exercised by legal persons and natural persons acting for purposes related to their professional activity. To exercise the right of withdrawal it is necessary to send the items for which you intend to exercise this right to the address of Ceramitaly, Via per Vignola 37 41053 Maranello (MO), within 10 working days of receipt of the goods.

The costs of returning the product shall be borne entirely by the customer. The right of withdrawal is totally invalidated if the returned product is not intact, i.e:

- lack of the original packaging

- absence of integral elements of the product (accessories, instruction manuals, etc.)

- damage to the product Ceramitaly will proceed with the transmission of the re-credit order relative to the cost of the goods shipped within 30 working days following the shipment of the goods by the customer and in any case not before the receipt of the goods.

Ceramitaly will consequently reject any product returned unpackaged, as well as products for which the Customer has not already paid the return shipping costs in full. Refunds will be made by bank transfer.

Guarantees and after-sales service

Products sold on the Ceramitaly website are covered by the manufacturer's legal guarantee of conformity, without prejudice to other legal provisions, from the date of delivery of the product. The cost of returning the faulty or defective product is the responsibility of the customer. Whatever the problem with the product, it must be returned accompanied by a copy of the invoice. Please note: the legal guarantee does not apply to repairs of damage caused by a cause external to the product (for example: accidents, shocks, lightning, power surges, etc.) or by a fault on the part of the customer (such as, for example, the use of an installation that does not comply with the manufacturer's specifications, use of the product that is harmful to it, use of the product for commercial or collective purposes, use of unsuitable peripherals and/or accessories and/or consumables).
